Introduction to Redundancy

Have you decided to alter your business operations and no longer require a job to be done, by anyone within your Practice? Read below to find out what is required to effect a genuine redundancy and prevent an unfair dismissal claim.
Redundancies can occur within a Practice for a number of reasons. There may be a reduction in work; technological advances may replace work carried out by an employee; or you may wish to re-align responsibilities within the Practice that limit the number of positions needed. Redundancies within a Practice can be stressful for the employer and the affected employee. As an employer, you are required to demonstrate that the redundancy is genuine by proving that:
- You no longer require the position to be performed by any employee.
- You have consulted with the employee prior to and once you have made a definite decision to terminate the employee’s position.
- You have attempted to redeploy the employee into another position within the Practice or associated Practice/s.
